Section IV - Permit Variances <br />Rule 2.06.2 - Experimental Practices Mining: The Colowyo Mine originally constructed <br />the Streeter Fill as an experimental practice under Rule 2.06.2. With the approval of <br />Technical Revision 10, approved on 28 August 1986, the division changed the status of <br />the fill from experimental and determined that the fill meet all of the requirements of <br />Rule 4.09. Detailed information regarding the Streeter Fill can be found in Permit <br />Sections 2.06.2 and 4.09 and in Exhibit 12. <br />Rule 2.06.3 - Mountaintop Removal Mining: The Colowyo Mine does not conduct <br />mountaintop removal operations. <br />Rule 2.06.5 - Permits Incorporating Variances from Approximate Original Contour <br />Restoration Requirements for Steep Slope Mining: The Division has granted Colowyo a <br />variance from approximate original contour for portions of the South Taylor Pit. A large <br />portion of the South Taylor Pit has slopes in excess of 20 degrees. Pursuant to Rule <br />2.06.5 (2), the Division has made the appropriate written findings regarding this variance. <br />The most recent findings were written for Permit Renewal 05 and are dated 15 September <br />2009. Additionally, pursuant to Rule 2.06.5(3)(c), the Division is required to "evaluate <br />the progress and development of the mining activities and to establish that the permittee <br />is proceeding in accordance with the terms of the variance... (n)ot later than the middle <br />of each permit term." At the present time Colowyo is still working on the box-cut for <br />the South Taylor Pit and no reclamation has been performed. Colowyo is placing <br />material from the box-cut into two permanent valley fills (the East Taylor Fill and the <br />West Taylor Fill) as described in the approved plan. The Division will continue to <br />monitor the activities in the South Taylor Pit and, pursuant to Rule 2.06.5(3)(b), will <br />review the progress prior to Permit Renewal 06. <br />Rule 2.06.7 - Variances for Delay in Contemporaneous Reclamation Requirements in <br />Combined Surface and Underground Mining Operations: Colowyo does not have any <br />combined surface and underground mining operations <br />Section V - Decision to Require Revisions or Additional Information <br />Based on a review of the permit application, the Division has the following questions for <br />Colowyo. The Division requests responses, in the form of a minor revision or technical <br />revision, as appropriate, from Colowyo no later than 25 June 2010. Several issues can be <br />combined in one technical revision. <br />A number of the issues detailed below are outstanding issues that have been discussed <br />during various permitting actions and Notices of Violation.
