• MINIMUM CUMULATIVE PLANTING AREA ACREAGE <br />(NOT LESS THAN 20 ACRES FOR ASPEN/TALL SHRUB <br />PLANTING SITES ON THICK SOILS, AND NOT LESS <br />THAN 20 ACRES FOR TALL SHRUB/BITTERBRUSH <br />PLANTING SITES ON THIN SOIL). BOTH ASPEN AND <br />TALL SHRUBS CAN BE PLANTED WITHIN THE SAME <br />THICK SOIL PLANTING SITES; <br />• AT LEAST/ 20F THE TOTAL ACREAGE OF PLANTING <br />SITES WILL BE OVER GRADED SPOILS, AND NONE OF <br />THE SITES WILL BE LOCATED IN CLOSE PROXIMITY <br />TO UNDISTURBED NATIVE HABITAT; <br />• DETAILED SEEDING AND PLANTING PLANS FOR THE <br />VARIOUS SITES. PLANTING PLAN SHOULD ADDRESS <br />SPECIES, PLANTING DENSITIES, PLANTING <br />METHODS, SIZE AND SOURCE OF PLANTING STOCK <br />(NATIVE WILDING, COMMERCIAL CONTAINERIZED, <br />ETC.). APPROPRIATE LOW COMPETITION SEEDMIXES <br />WILL BE SPECIFIED FOR THE THICK SOIL AND THIN <br />SOIL PLANTING SITES, RESPECTIVELY; <br />• FENCING SPECIFICATIONS TO EXCLUDE <br />UNGULATES; <br />• SPECIFICATION FOR WEEDGUARD FABRIC OR <br />EQUIVALENT TO SUPPRESS HERBACEOUS <br />COMPETITION IN IMMEDIATE PROXIMITY OF <br />PLANTED SEEDLINGS, AND; <br />• SITE LOCATIONS, SITE CONDITIONS, AND SOIL <br />THICKNESS SPECIFICATIONS FOR EACH PROPOSED <br />PLANTING AREA. SITE LOCATIONS CAN BE <br />TENTATIVE; DEPENDING ON SUITABLE <br />OVERBURDEN CHARACTERISTICS OR OTHER <br />FACTORS, AS LONG AS THE SPECIFIED MINIMUM <br />ACREAGE OF THIN SOIL AND THICK SOIL <br />ESTABLISHMENT AREAS AND CONFORMANCE WITH <br />ALL SPECIFIED REQUIREMENTS IS ACHIEVED. <br />While Colowyo has minimally addressed Stipulation 13 by <br />submitting Technical Revision 84, the revision submittal included <br />a plan for three small (approximately 1 acre) test plots rather than <br />the required 40 acres of reclamation. While the Division agrees <br />that test plots of this nature may be useful, they do not replace the <br />need and requirement to address the aspen and tall mountain shrub <br />reestablishment at the Colowyo Mine. These communities <br />represent important wildlife habitat and must be restored.
