is 5.41 acres), b) ponds and treatment facilities are not necessary for meeting the effluent <br />limitations of Rule 4.05.2 and applicable State and Federal instream standards, and c) <br />surface drainage will not mix with underground mine water discharge. Small area <br />exemptions were previously approved for these areas in the Seneca II Mine permit <br />application (4.05.2(3)(b)(i)). <br />B. Diversions and Conveyance of Overland Flow <br />Twenty three permanent postmine drainage channels have been constructed on the <br />reclaimed lands of the Seneca II Mine that are proposed for transfer to the PSCM. <br />Certified as-built designs for the permanent channels are provided in the PSCM permit <br />application in Appendix 2.05.3-E2.H-1 and on Maps 2.05.4 M3A through E. The <br />Division approved certified designs for the channels in the Seneca II Mine permit <br />application, as noted in the Seneca II findings document. The Division has also <br />approved Phases I and II bond release for the channels and the areas that drain to the <br />channels. The Division proposes to approve the channels as permanent features in the <br />PSCM permit area. The channels have been constructed to their approximate original <br />natural pattern for minimizing erosion, conserving soil moisture and promoting <br />vegetation. Channel SCIIPM-1 (the inlet channel of Pond 002) is a permanent channel <br />that drains a watershed greater than one square mile and, therefore, is designed for <br />safely conveying the peak discharge from the 100-year, 24-hour storm event in <br />accordance with Rule 4.05.4. All other permanent channels are designed for safely <br />conveying the peak discharge from a 10-year, 24-hour storm event in accordance with <br />4.05.3. <br />Thirteen permanent postmining stock ponds are on the reclaimed lands of the Seneca II <br />Mine that are proposed for transfer to the PSCM permit area. These ponds are used <br />primarily for livestock grazing and secondarily as wildlife habitat. The certified as-built <br />designs for the ponds are provided in Section 5 ofAppendix: 2.05.3-E2.H-1 of the PSCM <br />permit application. The Division approved the ponds as permanent structures in TR-35 <br />to the Seneca II Mine permit application. The approval included waiving the quarterly <br />inspection requirements of Rule 4.05.9(18). The approval of TR-35 was based on an <br />inspection report dated 6/17/03 which documented the adequacy of the safety <br />demonstration required by 4.05.9(18), and documented adequate embankment heights <br />and storage capacities. The TR-35 submittal included letters from all appropriate <br />landowners requesting that the stock ponds located within. their property boundaries be <br />left in place as permanent features. The Division proposes to approve the stock ponds <br />as permanent features in the PSCM permit area. <br />C. Sedimentation Ponds <br />The PSCM will primarily use sediment control pond:, for preventing additional <br />contributions of sediment to streamflow or runoff outside the permit area due to mining <br />disturbances. PSCM will use four existing ponds that are proposed for transfer from the <br />Seneca II Mine: 002, 003, 004 and the PeCoCo Impoundment.
