The following findings apply to roads in the PSCM permit area. <br />A. Haul Roads <br />Alternative criteria and specifications were not used during the design of haul roads or access <br />roads. (4.03.1(1)(e)). <br />The Division proposes to approve the following roads in the permit area as permanent <br />structures: A, A-1, B, B-1, C, E, and E-1. These roads were previously approved as <br />permanent in the Seneca II Mine permit application based on their compatibility with the <br />approved postmining land uses and landowners' requests for their retention (Findings <br />document for Seneca II Mine, permit C-80-005). The roads will be compatible with the <br />postmining land uses of the PSCM. The haul roads will be reduced to a width of twenty feet, <br />associated disturbance will be reclaimed, and the remainder of the roads left in place. <br />(4.03. 1 (1)(f)(i)). <br />II. Support Facilities - Rule 4.04 <br />Support facilities used in conjunction with the PSCM include the following structures: <br />various buildings (office, security, storage, electrical parts, bath house, pump house, vehicle <br />shop, welding shop, transfer etc.), parking lot, fences, fuel tanks, lube storage area, fuel and <br />oil storage area, power lines, electrical substation, conveyors, mine portal heaters, <br />compressors, ventilation systems, water well, and material and storage yards. All facilities <br />will be constructed to prevent damage or disruption of utility lines, water wells, railroads, <br />and pipelines which may pass over, through, or under the permit area. <br />III. Hydrologic Balance - Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />The Seneca II Mine currently discharges water from sediment control ponds that are fed <br />by storm runoff, spoil springs, and water treatment facilities on lands that, along with <br />the ponds, are proposed for transfer to the PSCM. These discharges are subject to <br />limitations in a permit issued to the operator of the Seneca II Mine through the Colorado <br />Discharge Permit System (CDPS). The discharge permit :includes a Spill Prevention, <br />Control and Countermeasure plan that requires preventative and mitigation measures. <br />In connection with the proposed transfer of lands and ponds to the PSCM, SCCC has <br />applied for a CDPS permit for continuing the pond discharges and adding to them <br />additional runoff that will result from disturbing lands in the PSCM surface facilities <br />areas and pumping of mine water from the underground workings. <br />The Division proposes to grant exemptions from the use of sediment control ponds in <br />three areas on the north side of road A, the office area and two warehouse/boneyard <br />areas. Section 6 of Exhibit 2.05.3-E2 of the PSCM permit application contains a <br />sedimentology model that demonstrates the areas qualify for the exemptions.
