Amendment will need to be submitted in accordance with Rule 1.8. Also, in <br />accordance with Rule 1.8, an Amendment will constitute a new filing with the <br />Division and the time for review will start over. The applicant will be required to <br />publish and mail a new notice of the application in accordance with Rule 1.6.6. The <br />Applicant will not be required to submit a new application fee. <br />OR <br />B. Submit a Technical Revision to the current 112c application with a modified permit <br />area including the acreage for the haul road but not changing the total permit <br />acreage. Thus the acreage necessary will need to be removed from a portion of the <br />proposed permit area to be applied toward the haul road. The Technical Revision <br />will need to be submitted in accordance with Rule 1.8. The applicant will need to <br />update the exhibits to account for the modified permit area. <br />Exhibit C Pre-Mining and Mining Plan Maps <br />2.) For both options, the applicant will need to supply updated Exhibit C maps accounting for the <br />haul road and the modified permit boundary and acreage. The maps submitted do not show the <br />entire length and location of the improved haul road. Also, the scale and scale house will need <br />to be indicated on the Exhibit C Maps. <br />3.) Please provide the dimensions of the improved haul road. <br />4.) The applicant indicates they plan to excavate adjacent to the northern permit boundary and <br />reclaim a 3:1 slope from the northern permit boundary with a southern aspect. However, the <br />northern permit boundary is a located at the base of the plateau. The applicant has indicated <br />they do not intend on disturbing the rim and side slope of the plateau. So, the mining and <br />reclamation plan map will need to be updated to portray the actual mining area. Please depict <br />actual locations of the planned excavation areas. <br />Exhibit E Reclamation Plan <br />5.) The Reclamation plan will need to be updated to discuss how the road will be reclaimed. Will <br />the entire length of the road remain in place? If it is to be left in place, it will need to be <br />depicted on the Exhibit F map. If only portions of the road are to be left in place, those portions <br />will need to be depicted on the Exhibit F map. If all or portions of the road are to be left in place <br />the applicant will need to submit a notarized statement from the landowner indicating they <br />approve leaving the road in place. If portions of the haul road will be reclaimed back to <br />rangeland, please discuss what steps will be taken to do so. <br />Exhibit F Reclamation Plan Map <br />6.) Please remove the "Mined Area -111 Permit" depiction on the Exhibit F map. This area will <br />need to be reclaimed in accordance with the approved reclamation plan. <br />7.) Based on the applicants answer to item #5 above, please depict the road appropriately on <br />the reclamation plan map.
