Box 580 <br />Rye, Colorado 81069 <br />RE: Sikes Pit #2; DRMS File No. M-2010-008; 112c Application <br />Adequacy Review #2 <br />Dear Mr. Baxter, <br />On April 23rd, 2010, the Colorado Division of Reclamation, Mining and Safety (Division) <br />conducted a pre-operation inspection of the site and observed several issues that impact the <br />current proposed mining and reclamation plan. Please address these issues below. <br />'Permit Acreage and Haul Road <br />1.) The proposed permit area encompasses a previously approved 111c operation (Sikes Pit; M- <br />2009-080). A haul road has been improved to allow access to the current 111 operation. The <br />road was measured to be approximately 5,544 feet in length from the scale house to County <br />Road Q. The permit boundary marked for the 111c permit area does not appear to be correct in <br />terms of shape and size. That boundary encompasses approximately 22.6 acres not the <br />currently approved 27 acres. The 111c permit area includes 3,400 feet of the current <br />constructed haul road, approximately 3 acres in size, to make the total approved permit area 30 <br />acres. The current affected land was measured to be about 11.5 acres plus 3.2 acres for the <br />improved haul road, for a total disturbance area of 14.7 acres. Given the incorrect shape and <br />size of the marked boundary for the 111c operation and the location and length of the haul <br />road, the operator may have affected land outside of the approved 111c permit boundary. <br />The proposed permit boundary for the 112c operation will encompass the majority of the <br />current mining disturbance; however, it does not include the area for a portion of the haul road. <br />Based on the Divisions measurements, the Operator will need to modify the current proposed <br />plan to include the haul road starting from where it enters the northern permit boundary to <br />where it connects with County Road Q; approximately 2600 feet. The applicant has two options: <br />A. Submit an amendment to the currently submitted permit application with an <br />updated permit acreage to account for the area of the haul road. This would <br />increase the proposed permit area by about 1-2 acres. The applicant would need to <br />update the 112c application pages and exhibits to account for this area.
