III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Rob Zuber, Dan Hernandez, and Jason Musick of the <br />Colorado Division of Reclamation, Mining and Safety (Division). The mine is a reclaimed surface mine <br />east of Walden, Colorado with a reclaimed loadout just south of the town of Walden. The weather was <br />warm and clear with no sign of recent precipitation. No snow covered the mine, loadout or access roads. <br />Records: Mine records were accessed and verified at the NWCC office in Steamboat Springs. See <br />attached Division checklist for availability of records. <br />Signs and Markers: Permit boundary markers are needed at the following locations at the loadout: at the <br />gate, along the east side of the permit boundary, anted along the west side of the permit boundary parallel <br />to the railroad tracks. <br />Roads: All roads were in good shape. <br />Hydrologic Balance: The loadout pond was generally in good shape with the following exceptions: <br />• The primary spillway pipe needs immediate cleanout at the downstream end. <br />• Willows exceeding 10 feet in height are growing in the channel below the emergency spillway <br />and on the embankment. These need to be removed. <br />• Minor rodent holes were observed in the embankment. These need to be filled. <br />The maintenance tasks for the problems with willows and rodent holes are not necessary if the pond is <br />reclaimed in year 2010. <br />A small discharge was observed from the primary spillway of the loadout pond.
