For part "b" of Adequacy Comment 3, please refer to previously submitted page 3-15a, specifically the <br />final paragraph under Kimber Pit Mining Area. The AE-Pit designation within the AAI report refers to the <br />set up of the geotechnical model by AAI. The reclaimed spoils of the AE-Pit, which lie north of the <br />currently designated K-Pit, were the weaker of the layers considered in AAI's model. AAI's report refers <br />to the impact of fill on stability of the area <br />Spoil from the K-Pit will be used to blend the mined and disturbed area of K-Pit and AE-Pit, to include a <br />portion of the previous G-Strike Pit, and the toe of the October landslide with the surrounding terrain. <br />As such, this is not "excess spoil," as defined by Regulation 1.04 (43a). The Horse Gulch Fill is the only <br />area that is proposed for the placement of excess spoil from the K-Pit. <br />In addition to the requested responses, you had requested that Jim Mattern amend bond costs in <br />Appendix A to account for the increase in bond liability associated with TR-106.
