6.4.1 Exhibit A - Legal Description <br />No comment. <br />6.4.2 Exhibit B - Index Map <br />No comment. <br />6.4.3 Exhibit C - Pre-mining and Mining Plan Map(s) of Affected Lands <br />3. As required by Rule 6.2.1(2)(a), all maps must contain the name of the Applicant, must be <br />signed by a registered land surveyor or other qualified person and must give the date the map <br />was prepared. Please revise the Pre-mining and Mining Plan Maps to include the <br />aforementioned elements. <br />4. The Mining Plan Map shows the affected area is approximately 32.9 acres; however, the <br />Applicant has listed the permit area as 40 acres on the Application form. Please clarify the <br />size of the permitted area and indicate if the permit area will be equal to the affected area. <br />The permit acreage is the total acreage included in the permit area, while the affected acreage <br />is the surface of an area within the state where the mining operation is being or will be <br />conducted, which surface is disturbed as a result of such operation. The Division <br />recommends the Applicant keep the permit acreage and affected acreage values the same in <br />order to avoid confusion as to which part of the mine site may be disturbed. Please revise the <br />Pre-mining and Mining Plan Maps to portray the total area to be involved in the operation, <br />including the area to be mined and the area of the affected lands. <br />5. The symbol used to delineate the affected area on the Pre-mining, and Mining Plan Maps is <br />the same symbol used to delineate other parcels of land. Please revise the Pre-mining and <br />Mining Plan Maps using a different line style or color to delineate the affected area.. <br />6.4.4 Exhibit D - Mining Plan <br /> <br />6. As required by Rule 6.4.4(f)(i), specify the maximum depth to which the deposit will be <br />mined and thickness and type of overburden to be removed. In addition, describe the nature <br />of the stratum immediately beneath the material to be mined. <br />7. As required by Rule 6.4.4(g), identify the primary commodity to be mined and describe the <br />intended use of the commodity. <br />8. The Applicant has stated gravel may be removed from the banks of Rock Creek. Please 1 / <br />specify whether the banks will or will not be disturbed. The Division recommends leaving <br />the banks intact as much as possible and limiting disturbance to a single access point., <br />Minimization of disturbance to the banks will reduce the efforts required for reclamation.
