Mike Boulay -5- March 3, 2008 <br />SCC: Enclosed is revised permit page 15-1 and new permit page 15-2. <br />7. DRMS: Rule 2.05.5(2)(a)(iii) requires narrative describing the consideration that has <br />been given to making all of the proposed surface mining activities consistent with <br />applicable state and local land use plans and programs. 2.05.5(2)(b) requires written <br />comments from the state or local government agencies that would have to initiate, <br />implement, approve, or authorize the use of the land following reclamation. Please <br />provide amended narrative addressing the requirements of 2.05.5(2)(a)(iii), with <br />respect to the disturbed lands affected by the PR-4 proposal, and also please <br />provide copies of applicable government agency (e.g. Mesa County Department of <br />Planning and Economic Development) comments concerning the proposed <br />postmining land use as required by 2.05.5(2)(b). <br />SCC: Enclosed, but not intended to be made part of the permit, is a copy of an <br />October 12, 2007 certified letter sent to the Mesa County Department of Planning & <br />Development requesting comments or concerns regarding the proposed postmining land <br />use. To date, Snowcap has not received a response to the letter. The "Surface <br />Landowner's Consent" was previously provided as appendix page A14-5-37 in the initial <br />submittal. <br />8. DRMS: Amended page 15-1 contains out-dated language that does not identify the <br />Mesa County Department of Planning and Economic Development as an agency having <br />responsibility for authorization of the proposed industrial land use. Further, narrative that <br />was incorporated by Permit Revision No. 3 (PR-3), regarding South Portal area zoning <br />and minor site plan approval was not included on the version of the page submitted with <br />the PR-4 proposed amendments. Please provide amended narrative that includes <br />the referenced updates. <br />SCC: Enclosed is revised permit page 15-1. <br />9. DRMS: The proposed industrial land use area includes a swath of land up to 400 <br />feet wide, approximately 15 acres in extent, bounded by Haul Road No.3 on the west, <br />the Colorado River on the east, Coal Creek on the south, and the loadout loop on the <br />north. The conveyor corridor passed through this area and was reclaimed within the last <br />several years. Much of the remainder of the area had apparently been disturbed by <br />activities associated with conveyor construction, and has since grown over with <br />rabbitbrush, greasewood, and tamarix. This area is designated "Inactive" Industrial Land <br />Use Area on amended Exhibit 10C. Please provide, within the amended Postmining <br />Land Use text, a discussion of the reasoning and justification for including the <br />referenced 15 acre area within the designated Industrial Postmining Land Use <br />Area. <br />SCC: Enclosed is revised Exhibit 10C which depicts a new access road and gravel <br />plated laydown/storage area which will incorporate the majority of this acreage. The <br />narrative has been revised on permit pages 14-9 and 15-1 describing the use of this <br />area. <br />10. DRMS: Please include within the revision application, appropriate <br />documentation to demonstrate that the proposed postmining land use is <br />compatible with adjacent land use, including documentation showing that any
