Mike Boulay -4- March 3, 2008 <br />SCC: The topography of the site within the rail loop has been amended and additional <br />information has been provided on the proposed industrial activities within the "active" <br />areas of the land use change. These changes are shown on revised Exhibits 10C, 11 C <br />and 59 and more fully described within revised and new permit pages 15-1 and 15-2. <br />2.05.4(2)(d) and 4.06 Topsoil <br />4. DRMS: Table 14-1 indicates some topsoil remains in Stockpile 4, which is located <br />within the "Inactive" portion of the proposed Industrial Land Use area, east of Haul Road <br />3, adjacent to the reclaimed conveyor corridor. We believe there is topsoil remaining in <br />the stockpile, but the volume indicated in the table may no longer be correct. Also, <br />Table 14-2 would appear to be out of date, and needs to be amended to reflect current <br />volumes, destinations, and status of operations. Please update the tables as <br />warranted, and update pertinent sections of the application tent to address <br />location and timing for use of remaining soil in Stockpile 4, as well as seedbed <br />preparation and seeding that would be conducted in the stockpile footprint area <br />and immediate vicinity following removal of the soil remaining in stockpile. <br />SCC: Enclosed are revised Tables 14-1 and 14-2 and permit page 14-3. The footprint <br />of stockpile 4 is included in the "active" area of the land use change. This area will be <br />disturbed during the construction of the new access road and may be used as an <br />additional laydown area. No initial seeding is planned for this area. <br />2.05.4(2)(f) Debris Disposal <br />5. DRMS: Please clarify in the amended Unit Train Loadout text on page 14-9, that <br />cleanup of coal remnants including coal fines for haulage to the approved <br />disposal site will be conducted over the entire rail loop disturbed area, including <br />along ditches, sediment pond inlet areas, the SAE bermed area along the toe of <br />the rail outslope near the loadout structure, and any other locations where coaly <br />material has accumulated. <br />SCC: Enclosed are revised permit pages 14-9 and 14-9i. <br />2.05.5(2) and 4.16.3 Postminino Land Use/Alternative Land Uses <br />6. DRMS: Rule 2.05.5(2)(a) requires a detailed narrative of the proposed postmining <br />land use, including discussion of how the land use is to be achieved and the necessary <br />support activities which may be needed. The plan presented in the application (narrative <br />in amended Section 2.05.5, and the various amended maps) provides only a "bare <br />bones" outline indicating that the loadout loop and associated facilities would be <br />converted to industrial/commercial use. No detailed information regarding the specific <br />nature of the industrial use, planned use of existing facilities to be retained, or additional <br />facilities to be constructed, has been provided. Please provide amended narrative <br />within Section 2.05.5 to meet the requirements of 2.05.5(2)(a). Please address the <br />nature and details of the planned industrial/commercial use, including the use of <br />facilities to be retained. Also, please address the planned uses of facilities to be <br />located within the rail loop "Active Use" area, which necessitate the proposed <br />relatively level grading of the entire site.
