III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the McClane Canyon Mine conducted by Mike Boulay of the <br />Division of Reclamation, Mining and Safety Grand Junction Field Office on April 21, 2010. There <br />was no operator representative present during the site inspection. However, I did speak with Gary <br />Isaac, Mine Manager for McClane Canyon Mining LLC (MCM) at the mine office prior to the <br />inspection. He indicated that MSHA inspectors were presently on site and were underground at this <br />time. <br />Availability of Records <br />The availability of records was checked at the mine office on the morning of April 21st. See the <br />attached records checklist at the end of this inspection report. The 2009 Annual Reclamation Report <br />and the 2009 Annual Hydrology Report were updated in the records file, as was requested during the <br />last complete inspection. The CDPS permit is still pending renewal approval. All required records <br />were on file and available for review. <br />Roads <br />Coal was being conveyed from the mine site, loaded on to trucks and hauled from the mine to the <br />Cameo Power Plant. The haul road and road ditches were properly maintained and in good condition. <br />Ditches had been cleaned throughout the site just prior to my inspection. Sediment traps and road <br />ditches had been cleared of sediment and debris. The haul road and associated ditches were recently <br />graded. Road and ditch cuttings are stockpiled in a few locations (see attached photographs) along the <br />haul road and near the inlet to the sediment pond. MCM is planning to remove the stockpiles of coaly <br />material/sediment and transport it to the temporary coal mine waste storage area atop the CRDA-1 pile <br />at Snowcap Coal Company's Roadside Mine. This is approved in the McClane Canyon Mine permit <br />application package and was also recently approved for the Roadside Mine to accept this material with <br />MR-75 (permit no. C-1981-041). This will allow for temporary storage of coal mine waste from <br />McClane Canyon Mine and from other ongoing reclamation activities at the Roadside Mine. <br />Hydrologic Balance <br />Weather conditions were cloudy and cool. Ground conditions were mostly dry. Drainage structures <br />and diversion culverts in the portal area were clear of debris and appeared to be functional. The <br />sediment pond was containing muddy water approximately one foot below the level of the principal <br />spillway. The pond inlet and embankment were stable. SAE silt fence structures appeared to be <br />maintained and functional. <br />The mine was not discharging water at the time of the inspection, but the water truck was filling with <br />mine water (which is piped from underground and out through the conveyor portal). The water is <br />applied to the haul road for dust suppression.
