within thirty (30) days after the date of the notice of default, the non-defaulting party may <br />terminate this Luse Agreement by written notice to the other party. <br />b. AUi 01%4ATIC: This Lease Agreement shall terminate automatically upon the <br />expiration of the Initial Term or Extended Term for which a timely written request for extension, <br />has not been provided pursuant to Paragraph 3 above. <br />c. NON-APPROPRIATION: County may terminate this Lease Agreement for an <br />event of non-appropriation as described in Section 10 of this Lease Agreement. <br />d. REMOVAL OF PROPERTY: Upon termination of this Lease Agreement, County <br />shall remove all stored aggregate and other personal property from the Premises within thirty <br />(30) days after the date of termination. Upon termination of this Lease Agreement, County shall <br />remove all equipment not necessary for the reclamation of the Premises required in Paragraph 5 <br />above, within thirty (30) days after the date of termination. <br />9. NOTICES. All notices, consents and comnlunieations required under this Agreement <br />shall be in writing and shall be deemed effective when hand delivered, when sent by certified <br />mail, return receipt requested, or when sent by electronic communication (facsimile), or when <br />sent by electronic rail, and correctly addressed as follows: <br />If to County: Mr. Brian W. LEASE SUBJECT TO ANNUAL APPROPRIATIONS. The parties agree and <br />acknowledge that this Lease Agreement does not constitute a multiple-fiscal year debt or <br />financial obligation of Montrose County pursuant to Section 20(4)(b) of Article X of the <br />Constitution of Colorado, based upon Montrose County`s ability to terminate this Agreement as <br />set forth herein. This Lease Agreement shall not obligate the County, directly or indirectly, to <br />make any Royalty payrents or meet any other monetary obligation required herein, beyond such <br />payments or obligations as are appropriated for any fiscal year in which this Lease Agreement is <br />in effect. In the event County fails to budget and appropriate, on or before December 31 of each <br />year, funds sufficient to pay all Royalty payments and other monetary obligations due for the <br />raext ensuing year, an Event of Non-appropriation shall be deemed to have occurred and this <br />3
