III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine site has completed reclamation of <br />disturbed areas, excluding ditches and sediment ponds. Ground conditions were dry in most <br />places and the weather was partly cloudy and mild. <br />Hydrologic Balance <br />Pond 5 continues to hold some water but was not discharging. The sediment marker <br />remains on the pond embankment awaiting installation. Pond 9, shown below, held a small <br />amount of water, well below the discharge point. The ditch above this pond has been a <br />problem due to the very steep grade as runoff from the reclaimed area above is directed to <br />pond 9, passing under a gas road. This ditch requires maintenance work to re-establish the <br />riprap channel to prevent further erosion and sedimentation (second photo below). <br />3
