III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Roadside Portals Mine conducted on March 25, 2010 by Mike <br /> Boulay of the Division of Reclamation, Mining and Safety Grand Junction Field Office. Tonya <br /> Hammond of Snowcap Coal Company(SCC)was present during the inspection. Weather conditions <br /> were sunny and cold. Ground conditions were mostly dry. <br /> Availability of Records <br /> The availability of records was checked on the morning of March 25`h. All required records were on <br /> file and available for review at J.E. Stover&Associates offices. No problems were noted with the <br /> records review. See the attached Availability of Records checklist at the end of this inspection report. <br /> Roads <br /> Roads were mostly dry and well maintained in the locations west of the interstate including the North <br /> Portal,Unit Train Loadout(UTL), and refuse disposal areas. Roads were also in good condition at the <br /> North Decline and South Portal areas. Road ditches were in good condition and road culverts were all <br /> generally well maintained throughout the various mine site locations and support facility areas that <br /> were accessible. The 2-West Portal and South Fan site locations could not be inspected due to muddy <br /> and poor road conditions. <br /> Hydrologic Balance <br /> All site sedimentation ponds including UTL-1 &2, 6, 7,8,9,10,11, and 13 were inspected. All <br /> sediment ponds were dry with the exception of Pond 8. Pond 8 was only damp at the bottom. The <br /> CBA#1 Sump was dry. The sedimentation ponds are all very well maintained and capable of <br /> functioning as intended. All pond embankments,inlets and discharge structures were stable and no <br /> problems were noted at any of the sediment pond locations. Pond.7 at the North Decline area is shown <br /> in Photograph No. 1. <br /> Drainage and diversion ditches site wide were stable with no significant erosion or other problems <br /> noted. Coal Creek was dry with exception of the very lower section below the UTL entrance/crossing. <br /> Support Facilities <br /> The entire South Portal reclaimed area remains stable and in good condition. The Kokopelli fruit stand <br /> is not open for business yet, and there is no activity at the South Portal location this time of the year. <br /> The reclamation at the South Portal backfilled area remains in good condition. The roughened slope is <br /> very stable with adequate vegetation(see attached photo No. 2). The RSRDA waste disposal site is <br /> well maintained. The Upper Diversion Ditch was inspected. The diversion ditch is adequately <br />
