section and be advised that a duly executed copy of the lease must be submitted to the <br />Division prior to proposing a decision on PR-03. <br />Rule 2.03.5 - Compliance Information <br />3. This item is considered complete. The Division agrees that the ownership and <br />controller information required by Rule 2.03.5 was updated with the approval Minor <br />Revision 98 (proposed decision date of 30 October 2009). Based on the timing of the <br />responses to this incompleteness letter and the length of the PR-03 review the <br />Division may request that this information be updated again. <br />Rule 2 03 12 - Newspaper Advertisement and Proof of Publication <br />4. This item remains incomplete. The proposed public notice for PR-03 is included at <br />the end of Volume 15 as Figure 2.03.12-2. In the second paragraph of the notice <br />Colowyo erroneously states that "Colowyo has obtained the mineral leases and right- <br />of-way agreements..." Based on question 2 above and the unleased federal coal in <br />Sections 19 and 24 in the Little Collom X Pit Colowyo will need to amend this <br />statement and resubmit the proposed public notice. <br />Rule 2.04.3 Site Description and Land Use Information <br />5. This item remains incomplete. In the response submittal to the Division's initial <br />completeness review, Colowyo provided additional site specific land use information. <br />The Division has the following comments regarding the materials submitted. <br />a. The Division requested that pre-mining land uses in the Collom expansion area <br />address wildlife habitat, and that the narrative in the site description and land use <br />section should describe the existing land uses in the expansion area using the <br />definitions of land use in Rule 1.04(71). <br />The amended narrative indicates that the predominant land use type identified in <br />the Collom expansion area is rangeland, with a minimal area outside of proposed <br />disturbance boundaries that has been characterized as pastureland. Map 17 "Land <br />Use" does depict Rangeland as the predominant category, along with small areas <br />of pastureland along Wilson Creek. <br />Based on information presented in various sections of the application, including <br />2.04.3 "Land Use Information", 2.04.11 "Fish and Wildlife Information", and <br />2.05.6(2) "Fish and Wildlife Plan", it is clear that the proposed Collom expansion <br />area provides important wildlife habitat that has been actively managed for <br />wildlife. In Section 2.05.5 "Post-mining Land Use", it is noted that "much of the <br />Collom area, especially western portions, has been managed under the Morgan <br />Creek Ranching for Wildlife Program, where livestock grazing has been reduced <br />to increase the quality and quantity of resident deer and elk populations for <br />Colowyo Mine C-1981-019 page 2 of 11 8 April 2010 <br />Permit Revision 03 - Collom Permit Expansion
