• facilities in the permit area including all buildings, structures, utility corridors and <br />other support facilities included but not limited to those listed in Rule 4.04." <br />Colowyo Response: <br />Section 2.05.3 has been amender. <br />Rule 2.05.3 (3) and 4.03.1- Haul Roads <br />11. Colowyo has proposed four new haul roads with PR-03. These roads are the Plant <br />Access and Coal Road, the East Haul Road, the Central Haul Road and the West Haul <br />Road. Please note that the Division does not consider the East Haul Road, the Central <br />Haul Road or the West Haul Road to be in-pit roads because their location, while <br />inside the disturbance boundary (as required) lies well outside of any actual pit <br />disturbance boundaries. Colowyo has not provided the designs required by Rule <br />2.05.3(3)(c). The four new haul roads will need to be designed and constructed as <br />required by Rule 2.05.3(3)(c) and Rule 4.03.1. Pursuant to Rule 4.03.1(1)(d)(i), the <br />design (and construction) of the haul roads needs to be certified by a registered, <br />professional engineer. <br />Colowyo Response: <br />Map 25D - Collom Haul Roads provides the designs for the West Haul Road, <br />Central Haul Road, and the East Haul Road. This map has been certified by a registered <br />professional engineer. Similarly, Maps 25E, Collom Access Road, Sheets 1 through 9 provide <br />design information for the Plant Access and Coal Road. These maps have also been certifier. <br />Rules 2.05.3 (3) and 4.03.2 - Access Roads <br />12. Colowyo is proposing to build one access road to the proposed LCX DIS sediment <br />pond. No designs for this road have been included. An access road design in <br />accordance with Rule 2.05.3 (3) and 4.03.2(1)-(7) is needed. Pursuant to Rule <br />4.03.2(1)(f)(i), the design and construction of the haul roads needs to be certified by a <br />registered, professional engineer. <br />Colowyo Response: <br />Design and construction of this road is provided with this submittal in Volume <br />20, Exhibit 25, Item 1. It should be noted that the name of this sediment pond has been <br />changed to the Little Collom sediment pond. <br />Rule 2.05.3(4) - Ponds, impoundments and other treatment facilities <br />13. Information required by this Rule was not found in the application for the single <br />sediment pond proposed. Rule 2.05.3(4)(a)(ii)(A) requires each detailed design plan <br />to be prepared by and certified by a registered professional engineer; Rule <br />2.05.3(4)(a)(ii)(B) requires a geotechnical investigation., design and construction <br />Colowyo Mine C-1981-019 page 5 of 16 25 March 2010 <br />Permit Revision 03 - Collom Permit Expansion
