Exhibit D <br />(Amended mining Plan) <br />Lyons Pit No. 2 - Permit No. M-80-248 Amendment No. 002 <br />Moffat County Road Department <br />Background: <br />Moffat County was issued a 110 permit on the Lyons Pit No. 2 in 1980, and in 1991 we <br />secured a Revision for a 112 permit for a total of 30.28 acres. Then in 1996 we executed <br />a Reclamation Responsibility Release for 10.7 acres on the western end of the permit, <br />leaving what we believed to be 20.91 active acres. Note: We have discovered an error in <br />computing the above net active acres, and would like to correct that error now. <br />30.28 acres = (112 permit total) <br />-10.70 acres = (Release) <br />19.58 acres = Corrected netacres after the Release <br />+20.00 acres = Amendment 001 <br />39.58 acres = Net acres including Amendment 001 <br />+30.63 acres = Proposed Amendment 002 <br />70.21 acres = Corrected total net active acres including Amendment 002 <br />Purpose: <br />Amendment No. 1 has been effectively mined-out. The purpose of Amendment No. 002 <br />is to increase our gravel resources to the east and south of Amendment No. 001, making <br />the total affected area of the Lyons Pit No. 2 = 70.21 acres more or less as corrected <br />above. (See Exhibits B and C-1). <br />Access: <br />The access to the Lyons Pit No. 2 is shown on Exhibits B, B-1, & B-2. The private access <br />road begins on Colorado Highway No. 394 at Mile Post No. 6, and then proceeds north <br />for approximately one mile to a cattle guard marking the west boundary of the Lyons Pit <br />No. 2. <br />Mine Entrance: <br />The Mine Entrance sign is mounted on the fenceline just south of the cattle guard. <br />The GPS Location for the mine entrance is: <br />N40.50903 Degrees <br />W 107.46242 Degrees <br />Mining Plan: <br />The general information in the Mining and Reclamation Plans for the "1991 ,Revision", <br />and in the "1997 Amendment No. 001," is incorporated into this Amendment No. 002 <br />Mining Plan by reference, along with the following "Conditions of.4pproval " dated <br />March 28, 1991: <br />Moffat County will replace a minimum of twelve inches of topsoil over all <br />affected land during reclamation.
