The paved access road was not present prior to issuance of the current <br />mining permit. A portion of the road will be removed prior to mining Phase <br />2 Cell 5. Removal of this portion of the road is considered part of the <br />overburden stripping operation and is therefore not included as a line item <br />in Exhibit L. <br />34. The applicant will commit to not mining within 200 ft of from any <br />permanent man-made structure without first providing a notarized <br />agreement between the applicant and structure owner or where such <br />structure is a utility, the Applicant may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that the mining and reclamation <br />activities, as proposed, will have "no negative effect on their utility. The <br />Western Area Power Administration has verbally agreed to provide such a <br />letter and we are expecting it within the week.
