III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Kent Gorham and Rob Zuber of the Colorado <br /> Division of Reclamation, Mining, and Safety(Division). This mine is in permanent cessation <br /> and reclamation of most areas is complete. The weather on this day was sunny and <br /> temperatures were mild. Ground conditions were snow-covered and extremely muddy. <br /> Availability of Records <br /> The public copy of the mine records is kept at the Energy Fuels Coal Company (EFCC) office <br /> in Florence. George Patterson of EFCC was present during the records inspection. Specific <br /> details regarding the records inspection can be found on page 2a of this report. All records <br /> were found in compliance. <br /> Roads <br /> The section of County Road 92 leading to the reclaimed facility area was very wet and <br /> extremely muddy. The top few inches of the road surface were thawed but the road sub- <br /> base seemed frozen, making the road nearly impassable in a vehicle. The inspection began <br /> on foot after parking near the small permanent parking area on the Vento property. <br /> Hydrologic Balance <br /> Two ponds exist at the main facility site, Pond 4 located below the RDA on the Vento <br /> property and Pond 5 below the reclaimed main facility located on the Corley property. Two <br /> ponds remain at the reclaimed coal loadout one mile west of Florence. All ponds were found <br /> dry. All primary and emergency spillways appeared in good structural condition. All ponds <br /> have significant capacity to <br /> store storm runoff and _ <br /> sediment given the _ <br /> revegetated condition of all <br /> disturbed areas. One <br /> maintenance issue was <br /> noted at pond L1 (shown at <br /> right). Due to wildlife and/or <br /> livestock trampling above the <br /> primary riser, soil upslope of <br /> the riser has encroached ;t <br /> very near the drop inlet to the <br /> spillway structure. The <br /> operator should excavated above above the riser to <br /> prevent sediment from <br /> entering the drop inlet. <br /> 3 <br />
