The Operator is in the process of applying for a new permit for the May Day <br />Mine site. The Operator may propose on-site disposal of the mill facility in the new permit <br />application. After the Division reviews the new permit application, it may reduce the amount <br />of the financial warranty necessary for the site pursuant to § 34-32-117(4)(a) and (c)(I)(A), <br />C.R.S., and Hard Rock Rule 4.2.1(1) and (2). <br />17. The Operator wants the Division to factor into the reclamation cost calculation <br />the significant cost savings of disposing of the mill facility on-site. However, the site's <br />current reclamation permit does not provide for on-site disposal of the mill facility. Because <br />the Operator constructed the mill facility and portal at Level 1 prior to receiving approval <br />from the Division, the mill facility is not included in the site's mine plan or reclamation plan. <br />The financial warranty for permit number M-1981-185 is not sufficient to cover the actual <br />costs of reclaiming the site as it exists now. <br />ORDER <br />The Board hereby affirms the Division's Notice of Increase in Financial Warranty <br />totaling $148,329.
