of Deficiency.
Dear Mr. Ponchak,
The Division of Reclamation, Mining and Safety (DRMS) has reviewed the response submitted by
Mount Sneffels Mining Company, LLC regarding the January 12, 2010 Notice of Deficiency for File
No. P-2009-038. The application cannot be approved until the following issues are adequately
addressed. Please submit a response along with an extension request of the decision date to allow the
Division adequate time to review responses submitted. If your written request for an extension of the
decision date is not received by March 12, 2010 the application will be denied.
1. Senate Bill (SB) 228 became law on June 2, 2008. SB -228 requires all NOI applications to
submit Forms 1 & 2 along with an electronic format of both Forms 1 & 2. Enclosed is a
document that explains the implementation procedures for SB-228 and a blank Form 1. Please
provide all required materials to comply with the requirements of SB-228.

2. Please provide a seed mix and revegetation plan for staff review.

3. Please provide a detailed description of the proposed plugging and abandonment (P&A) for each
proposed drill hole with more specific depth estimates. Conflicting statements are within the
application regarding the proposed method for P&A. Please clarify whether or not the entire
length of the drill holes will be fully or partially cemented. Also please provide a detailed
reclamation cost estimate with a cost break down for each hole, cost of surface reclamation and
revegetation.
• The response submitted states that "There are four drill sites (1-4) which are
within the Ruby Trust Mine site permit boundary (Permit No. M-1979-181).
