Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Mount Sneffels Mining Company, LLC, Notice of Intent (NOI) File No. P-2009-038 2 d Notice <br />of Deficiency. <br />Dear Mr. Ponchak, <br />The Division of Reclamation, Mining and Safety (DRMS) has reviewed the response submitted by <br />Mount Sneffels Mining Company, LLC regarding the January 12, 2010 Notice of Deficiency for File <br />No. P-2009-038. The application cannot be approved until the following issues are adequately <br />addressed. Please submit a response along with an extension request of the decision date to allow the <br />Division adequate time to review responses submitted. If your written request for an extension of the <br />decision date is not received by March 12, 2010 the application will be denied. <br />1. Senate Bill (SB) 228 became law on June 2, 2008. SB -228 requires all NOI applications to <br />submit Forms 1 & 2 along with an electronic format of both Forms 1 & 2. Enclosed is a <br />document that explains the implementation procedures for SB-228 and a blank Form 1. Please <br />provide all required materials to comply with the requirements of SB-228. <br />• February 11, 2010 response is adequate. <br />2. Please provide a seed mix and revegetation plan for staff review. <br />• February 11, 2010 response is adequate. <br />3. Please provide a detailed description of the proposed plugging and abandonment (P&A) for each <br />proposed drill hole with more specific depth estimates. Conflicting statements are within the <br />application regarding the proposed method for P&A. Please clarify whether or not the entire <br />length of the drill holes will be fully or partially cemented.
