A copy <br />of the letter attached for your reference is as follows: <br />• IoBllen Turner and Mike Morgan Rec'd. 27--Jan-2010 <br />Section 2.07.3(5) states, "Any person having an interest which is or may be adversely <br />affected by a decision of the Division regarding, the proposed surface coal mining <br />operation... shall have the right to submit written objections to or comments upon the <br />initial or revised application for a... permit revision... to the Division within 30 days <br />after the last publication of the... notice. Suck objections and comments shall <br />immediately be transmitted to the applicant by the Division and shall be made available <br />to the public, at the same locations as the application." <br />A fi fth and unnecessary) publication of the co noti(in the San MiQtzel Basin Forum) <br />occurred on Thursday, 31 December 2009. There ore, the public comment period <br />remained open through Monday, 01 February 2010. This transmittal represents the <br />final comment and objection letter that was received within the public comment <br />period. In accordance with the Section quoted above, please. make. a copy of this <br />letter available at the Nucla Annex for public review. >??
