A copy r r <br />of the letter attached for your reference is as follows: <br />• JoElien Turner and Mike Morgan Recd. 27-Jan-2010 to ? C\ <br />Section 2.07.3(5) states, "Any person having an interest which is or may be adversely <br />affected by a decision of the Division regarding the proposed surface coal mining <br />operation... shall have the right to submit written objections to or comments upon the <br />initial or revised application for a... permit revision... to the Division within 30 days <br />after the last publication of the... notice. Such objections and comments shall <br />immediately be transmitted to the applicant by the Division and shall be made available <br />to the public, at the same locations as the application." <br />A fifth and unnecess ublication of the notice (in the San Miguel Basin Forum) <br />111?u occurred on Thursday, 31 December 20097There ore, the public comment period <br />remained open through Monday, 01 February 2010. This transmittal represents the <br />final comment and objection letter that was received within the public comment <br />period.
