11. On August 28, 1992, the permittee was issued Notice of Violation No. C- <br />92-027 for failure to maintain roads. <br />12. On October 6, 1992, the permittee was issued Notices of Violation Nos. <br />C-92-028 and C-92-029 for failure to maintain permanent impoundment <br />15-P2 and for failure to maintain sediment pond 15-P11. <br />13. On February 22, 1993, the Administrator of the Division of Minerals and <br />Geology determined that a Pattern of Violations as defined in Rule <br />5.03.3(2) existed at the Trinidad Basin Mine as a result of the permittee <br />receiving Notices of Violation Nos. C-92-013, C-92-014, C-92-020, C-92- <br />021, C-92-028 and C-92-029. <br />14. On April 22, 1993, the Division held a formal public hearing pursuant to an <br />Order issues by the Division on February 22, 1993 to Trinidad Basin <br />Mining Company to Show Cause Why its Permit Should Not Be Revoked <br />and subsequently revoked Permit No. C-81-048. <br />CONCLUSIONS OF LAW <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by CRS 33-34-124(4) and Rule 3.04.1(1), and based upon <br />the aforementioned Findings of Fact the Board hereby concludes the following: <br />1. The permittee has failed to conduct the surface mining and reclamation <br />operations in accordance with the Act these Rules and the permit within <br />the time required. <br />2. The permittee has failed to comply with the reclamation schedule as <br />outlined in the November 14, 1984 Board Order. As such, establishing a <br />new schedule per Rule 3.04.1(2) would be inappropriate. <br />3. It is necessary in order to fulfill the requirements of the permit and the <br />reclamation plan to have someone other than the permittee complete <br />reclamation. <br />BOARD ORDER <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by CRS 33-34-124(4) and Rules 3.04.1, 3.04.2 and 3.04.3, <br />the Board hereby orders the following: <br />1. The performance bonds submitted by Trinidad Basin Mining Company for <br />the Trinidad Basin Mine in the amount of $132,280.00 shall be forfeited in <br />10
