Order had resulted from a Pattern of Violations being determined to exist <br />from Notice of Violation Nos. C-83-31, C-83-32, C-84-027, C-84-071, C- <br />84-072, and Cessation Orders Nos. CO-84-138 and CO-84-146. As a <br />result of the issues raised in the Hearing the Board suspended the permit <br />and ordered reclamation of the site by July 31 1985. <br />2. On February 5, 1985, the permittee was issued Notices of Violation Nos. <br />C-85-005 and C-85-006 for failure to construct a sediment control system <br />and for failure to repair rills and gullies. <br />3. On August 6, 1985, the permittee was issued Notices of Violation Nos. C- <br />85-072 and C-85-073 for failure to complete reclamation in accordance <br />with the Board Order of November 14, 1984 and for failure to complete <br />reclamation of the mine loadouts. <br />4. On November 25, 1985, the permittee was issued Cessation Order No. <br />CO-85-84 for failure to abate Notice of Violation No. C-85-073. Also on <br />November 25, 1985, the Board held a formal public hearing and accepted <br />voluntary reclamation by the operator of $52,950.00 as payment for civil <br />penalties totaling $24,760.00. <br />5. On June 11, 1986, the permittee was issued Notices of Violation Nos. C- <br />86-048 and C-86-049, for failure to maintain ID signs and for failure to <br />maintain ponds 15-P10 and Cessation Order CO-86-50 for failure to <br />prevent tension cracking and erosion in a backfilled area. <br />6. On October 1, 1986, the permittee was issued Notices of Violation Nos. <br />C-86-068 and C-86-069 for failure to maintain sediment pond 15-P20 and <br />for failure to repair gullies. <br />7. On November 4, 1986, the permittee was issued Notice of Violation No. <br />C-86-073 for failure to follow the mine site hydrology monitoring plan. <br />8. On July 26, 1991, the permittee was issued Notice of Violation No. C-91- <br />009 for failure to properly treat disturbed area runoff. <br />9. On July 16, 1992, the permittee was issued Notices of Violation Nos. C- <br />92-013 and C-92-014 for failure to maintain sediment pond 15-P1 and for <br />failure to treat disturbed area drainage. <br />10. On August 14, 1992, the permittee was issued Notices of Violation Nos. <br />C-92-020 and C-92-021 for failure to maintain sediment pond 15-P11 and <br />for failure to maintain permanent impoundments 15-P1, 15-P2, 15-P20, <br />and 22-P17. <br />9
