Mr. Vern Pfannenstiel <br />March 2, 2010 <br />Page 2 <br />requires description of all support facilities. Rule 2.10.1(1) requires that a map of the <br />disturbed area include all support facilities. Rule 2.10.3(1) allows the Division to require <br />that a map show relevant information, for good cause shown, based on site-specific <br />condition. To ensure compliance with Rules 2.03.3(l), 2.05.3(3), 2.10.1(1), and in <br />accordance with Rule 2.10.3(1), please identify on Maps 2.05.3 MIA and M I B the <br />support facilities that are proposed in the two areas. <br />62. Please revise text so that "disturbed area" as defined in Rule 1.04(36) is clearly <br />distinguished from the area proposed to be disturbed or re-disturbed by PSCM activities <br />incidental to underground mining activities. The distinction may be accomplished by: <br />a) Inserting at an appropriate place in the text statements similar to the following, <br />The total disturbed area of the PSCM is acres, comprised of acres where <br />PSCM will conduct activities incidental to underground mining activities and <br />acres previously disturbed by Seneca 11 Mine activities. Throughout this permit <br />application, a reference to the "disturbed area" or "surface disturbance area" <br />applies to only the areas where there will be activities incidental to PSCM <br />underground mining activities, unless the reference specifically includes <br />previously mined lands where activities incidental to underground mining will not <br />be conducted, <br />b) Revising the text where the distinction is particularly unclear, for example on pages <br />2.04-140,2.05-8, and 2.05-47, and in Tables 2.04.3-T1, 2.04.10-T2, 2.04.10-T3. <br />63. If the boundary of the PSCM surface facilities disturbance is changed in response to <br />DRMS adequacy comments 54, 61, or 62, the change can be shown on maps by: <br />a) Revising Map 3.02.2 M1 to show the changed surface facilities disturbance boundary, <br />b) Attaching to the appropriate maps an adhesive label that has text similar to the <br />following, <br />NOTE: The disturbed area boundary or surface disturbance boundary <br />is incorrectly shown on this map. See Map 3.02.2 M1 (Bond Release Status) <br />for the correct disturbed area boundary. <br />c) Re-certifying the appropriate maps with a single page inserted in the permit, and <br />d) DRMS attaching a stipulation to the approval of the permit application requiring - <br />submittal within 30 days of the approval becoming final, maps showing the correct <br />disturbed area boundary.
