be available for EVERYONE and when the soils showed a PH of less than 8.4, the DRMS <br />should have and by LAW had to know that these soils were in-fact PRIME and by LAW had to <br />• contact the secretary of Interior as well as the U.S. Department of Agriculture and BEFORE <br />WESTERN FUELS SHOULD HAVE EVEN BEEN ALLOWED TO ENTER OUR <br />PROPERTY, EVERYTHING CONCERNING RECLAMATION AND SOIL HANDLING <br />HAD TO BE DISCUSSED AND WORKED OUT. <br />(3) Since Mel Staats lawsuit, Ross and Lance said that there would NEVER be any <br />more Prime Farmland within the permit. <br />(4) Ross Gubka withheld valuable information and knew well in advance that this was <br />PRIME because we told him what the Department of Agriculture said and we knew it was prime. <br />(5) DRMS should have also known if they were doing there job and performing their <br />inspections as the law states and if at any time the DRMS would have ASKED the FARMER as <br />the law states there should be communication. DBMS job was to make sure that the <br />OPERATOR which was WFC was doing their job. NOT JUST TAKE EVERYTHING THEY <br />GAVE TO YOU AS FACT! You had all of the facts in your office to make sure that the <br />operator was correct, especially on PRIME FARMLAND <br />(7) For three days and three nights WFC removed our Prime soils from our place and put it on <br />Bensons. <br />(1) The first day that Lance Wade was confronted at his office by Frank Morgan and Mike <br />Morgan, Lance said this is a Communist State, those who have give and those who don't take. <br />(2)I began calling every number in the yellow pages and blue pages that had to do with <br />mining. 25 calls leaving messages everywhere. Finally contacted Dan Mathews from the <br />• DRMS. He said WFC can't be. I said they are. AFTER 3 DAYS AND 3 NIGHTS, IT <br />FINALLY CEASED. Why did it take so long to get them from removing our PRIME topsoil?? <br />(3) This prime soil is as valuable to us as the coal is to WFC. IT CANNOT BE <br />REPLACED!!! A substitute BENCH ONE material is NOT the same and all of them just swept <br />it under the table as to the TRUTH as to what happened. The DBMS also did not investigate <br />FOR THEMSELVES. Again, the DRMS just took Ross Gubkas WORD. <br />(4) Intermountain Resources actually documented that our property was PRIME <br />(5) They also documented that there are ALLUVIALS which Ross says there are none in <br />the permit area, there are. <br />(6) It was documented as being a Class 1 survey very intensive and even if it was a Class 2, <br />it stated that our property was PRIME which using the National Criteria for Prime soils, the <br />DBMS should have checked this out for themselves in 1998! 111 <br />(8)DRMS obviously do not understand what PC means. PC is potential Cropland, a fancy word <br />for DRYLAND. DRMS might inform their director that PC is DRYLAND. DRYLAND has its <br />main SHRUB as SAGEBRUSH and must be compared to the DRYLAND at the AIRPORT. <br />(1) This was a fancy terminology that actually Marcia came up with right at our dining <br />room table Marcia thought this would sound much better than dryland since PEABODY NH1 <br />was such a sore spot to everyone in this area If this terminology was used for our benefit, then <br />shit is shit no matter if you try and make it smell like a rose or not. OUR PROPERETY WAS <br />PRIME FARMLAND IN IRRIGATED CROPLAND AND NEEDS TO BE PUT BACK IN <br />FULL PRODUCTION. <br />0
