• All of the irrigated pre-mine lands were "wild flood irrigated", water was simply allowed to flow <br />over the land at will. All of the farmers here are very insulted by that. First we have NEVER <br />WILD FLOOD irrigated and the Morgans personally have not flood irrigated for 39 years. Flood <br />irrigation requires numerous hours of work, hard and constant work, that's why most of us have <br />gone to gated pipe, side rolls, big guns, or center pivots, ALL of these methods were done many <br />years before the mine entered our properties. We had no abandoned orchard and it was not dry <br />land. Our orchard was in a mixed grass and alfalfa which maps will show we irrigated it <br />constantly and ate and canned the fruits every year. You cannot take one map per year and draw <br />your own conclusions. In 1998 the aerial photo of the Sunshine Place was very very green on the <br />easterly portion because that was our first year of planting AV 120, a new type of alfalfa and the <br />westerly part of the photo was planted for 8 years and the following year it was planted in corn <br />and then the next year in wheat. Also, this photo was taken right after we had cut the westerly <br />portion, so to judge us is discrimination and without knowing the facts, you have no right to <br />make a conclusion. IF IT IS GREEN, IT IS IRRIGATED AND CROPPED! ! ! ! ! ! ! ! ! <br />Irrigated crop land and pasture land are very similar and can be used interchangeably. Letter <br />from NRCS showing this is also a false statement Lands were originally classified to be restored <br />to irrigated but this was not valid because Also on the map of no water available. This is also a <br />false statement. All of these farmers not only produced crops, but had adequate grazing available <br />with much less water than what WFC is requesting. The Sunshine place which includes another <br />31 acres of land that was currently a corn field producing close to 700 tons of silage this year, <br />was also included in the 45 shares that was available since 1996 and a maximum of 60 shares all <br />• the years before that date. And these shares were doing over 120 acres and we left 50 shares for <br />WFC to use for reclamation and have offered another 12 shares which they have refused to add <br />to the 50. <br />The Lloyd property also well irrigated and leased by Gordon and Lori Smith for the past 10 years <br />which they have furrow irrigated and planted wheat several times. Bensons who had also very <br />nice fields and furrow irrigated. Also on the Lloyd property, it states only one of the property <br />owners live in state, that is also incorrect, one lives here and one Cedaridge. <br />The Johnson Property was a terrible lie especially when there was 100's and 100's of feet of gated <br />pipe and produced 319 tons of hay prior to the mine entering the property. <br />And now to the Morgan property, which is very up setting. Corrugated irrigation pipe. We have <br />never used nor is there such a thing unless you think we irrigate with a culvert. Even after I told <br />you this was not correct, I receive another document stating corrugated ditches/pipe. To clarify <br />this, a corrugate is a furrow and can be used interchangeably Ross has Massive amounts up tp <br />70 shares of water or 2cfs for the eastern 22.89 acres. This is a horrible false statement and <br />misrepresentation of the facts. 70 shares on 22 acres, we would have a Lake and maybe could go <br />fishing. I t states that our furrows were 1280 feet and took 10 or more days to irrigate. This was <br />also a lie. As you can see on the map, we had 2 sets of gated pipe and a big gun and usually we <br />were finished in 3-5 days. When Mr. Morgan was asked how many shares he used to irrigate the <br />• 100 acres, he said 50. A very factual statement. He also told Ross many times, there is more <br />available if needed but the Morgans were always able to irrigate all of this with that amount and
