III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) on 24 February 2010. The weather was clear and the <br /> mine site was snow covered during the on-the-ground inspection. Scott Wanstedt of BME <br /> accompanied the inspection. <br /> The mine is currently operating as permitted. No drilling activities were in progress during the <br /> inspection. Deserado Mine continues to longwall in panel 10 with coal cars being loaded at the rail <br /> loadout. <br /> Availability of Records <br /> See attached DRMS availability of records. All records were inspected at the Deserado Mine office. <br /> Signs and Markers <br /> In reference to perimeter markers, BME has submitted a proposal of BMEs compliance of 4.02 in <br /> reference to perimeter area markers for the Divisions review. The Division is in process of reviewing <br /> BMEs proposal at the time of this inspection. <br /> All mine ID signs observed were in place at the time of the inspection. All required information was <br /> observed on the ID signs. <br /> Topsoil and subsoil markers were in place at the required locations. No problems were noted. <br /> Roads <br /> The haul road was clear of snow and stable at the time of the inspection. Access roads in and around <br /> the facilities area, conveyor and the refuse disposal area were snow covered and stable. Roadside <br /> ditches and road culverts were snow covered at the time of the inspection with no problems noted. <br /> Hydrologic Balance <br /> DP-1 pond was snow covered at the time of the inspection. The embankments were stable and snow <br /> covered at the time of the inspection. The principal and emergency spillways were stable and in <br /> compliance at the time of the inspection. No discharge was noted. <br /> PP-1 and PP-2 ponds were iced over and snow-covered at the time of the inspection. Embankments <br /> were snow covered and stable. No problems were noted. <br /> SS-1 and SS-2 ponds were snow covered at the time of the inspection. Embankments were stable <br /> and snow covered and spillways were in compliance with no problems noted. <br /> Ponds RP-2/3, 4, and 5 were snow covered with no ice noted. Embankments were snow covered <br /> and stable with o identifiable compliance issues noted. <br />
