Cattany <br />Division Director <br />Natural Resource Trustee <br />I have reviewed the application per your request for subsidence and seismicity. Items reviewed <br />included your memorandum; J.E. Stover & Associates, Inc letter of February 28, 2006 (Stover <br />letter); the Permit Application Package, the revision application, and the BLM letter of February <br />28, 2001 (Amended Special Stipulations). I did not review this application for impacts to <br />hydrologic features (defer to Kent). Overall, the application well describes the proposed changes. <br />General subsidence issues associated with the proposed mining changes include the restrictions <br />from mining under Dove Creek and Dove Cave by the BLM leases, and protection of the Bruce <br />Park Dam and Terror Creek Reservoir. <br />Rule 2.04.3(c) See the Rules for the text of his rule. See Rule 2.10.3(1)(k). <br />Rule 2.04.4(1) The application shall contain a description of the cultural and historic resources <br />listed or eligible for listing on the National Register of Historic Places and significant known <br />archaeological sites existing on the date of application within all areas proposed or likely to be <br />affected by surface activities or planned or probable subsidence over the life of the mine. The <br />description shall be based on all available information, including, but not limited to, data of <br />State and local archaeological, historical, and cultural preservation agencies. <br />Pages 2.04-9 and 2.04-9i and Volume VI of the PAP is such a description. This revision adds two <br />sites. Page 2.04-9i should be revised to include this revision. <br />The Stover letter of February 28, 2006 addresses, in paragraph 3, Dove Cave. Concluded in the <br />cultural survey (Volume VI) is that the Ruben Dove Shelter (or Dove Cave) site 5DT1325 is not <br />eligible for nomination to the National Register of Historic Places (NRHP). The BLM amended <br />special stipulation (BLM letter of February 28, 2001) states "(4) The lessee/operator is required <br />to take measures to ensure that Dove Cave is protected from the negative effects of subsidence, <br />and that it's structural integrity is maintained." <br />Office of <br />Mined Land Reclamation Office of <br />Active and Inactive Mines
