III. COMMENTS - COMPLIANCE <br /> Williams Fork Mines C-1981-044 <br /> 9 February 2010 <br /> Pg3/3 <br /> Slides and Damage: - Last quarter it was noted that there was a fuel spill at the 5A <br /> portal area (as a result of pumping the remaining product and tank sludge from a <br /> diesel tank). Brian was unsure whether or not this spill had been cleaned up <br /> (although he thought that it may have been). As part of the clean-up and <br /> remediation, BTUEC will need to perform organic testing of the spill area to determine <br /> what was spilled. They will then need to clean the spill area and remove the <br /> contaminated soil to an approved landfill or an approved remediation area on the <br /> site. Once the contaminated soil is removed BTUEC will need to again sample the <br /> area to verify that all of contaminated soil has been removed. If all of the soil has not <br /> been removed, BTUEC will need to continue excavating and removing soil until all the <br /> contaminated soil is removed (verifying the complete removal by negative results <br /> from the soil testing). The area will then need to be filled and regraded (this may <br /> require a revision if material is to be borrowed from another location on the mine site <br /> that is not permitted as a borrow area). BTUEC will need to provide a final report of <br /> the clean-up to the Division immediately upon completion. This report needs to <br /> include, at a minimum, a description of the clean-up activities, all of the lab results <br /> (including an explanation of the findings), receipts for the soil disposal and a <br /> summary of the reclamation of the area. This information will also need to be <br /> included in the appropriate year's Annual Reclamation Report. Please contact the <br /> Division if BTUEC has any questions regarding the clean-up. <br /> - There was a downed power line on the East Side of the mine (in the area by the <br /> 100,000 gallon water tank and Pond SH-P2). BTUEC had contractors on site fixing the <br /> downed line. <br /> This concludes the 9 February 2010 Inspection report for the Eagle Mine. <br />
