Cattany <br />Division Director <br />or <br />Natural Resource Trustee <br />Paonia, Colorado 81428 <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC <br />Technical Revision No. 51, Keep Excess Rock at Paonia Sewage Lagoons, Adequacy <br />Review <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy <br />review of Bowie Resources LLC's (BRL) submittal of Technical Revision No. 51 (TR-51) for <br />the Bowie No. 2 Mine. In TR-51, BRL is proposing to keep the Hubbard Creek vent shaft pad <br />excess rock at the Paonia sewage lagoons rather than transporting it to the Bowie No. 1 Mine. <br />The Division has no objections to this proposal since it benefits the Town of Paonia. However, <br />this proposal does not appear to directly fall under any of the Division's regulations. Therefore, <br />the Division's adequacy review is centered on ensuring that the permanent storage of excess rock <br />at the Paonia sewage lagoons will not jeopardize the environment or the reclamation of the vent <br />shaft site and that all parties are in agreement with the plan. The following are the Division's <br />comments: <br />1. Please provide a geochemical analysis of the excess rock currently at the Paonia sewage <br />lagoons that shows that the material is non-toxic and non-acid forming. <br />2. Revised permit application page 2.05-39ii in TR-51 states that exporting 3,000 cubic <br />yards of excess rock from the Hubbard Creek vent shaft pad site would lower the <br />reclamation topography of the site by 1.2 feet. The Division finds this acceptable in <br />achieving approximate original contour. <br />3. The TR-51 submittal included letters from the USDA-Forest Service and the Town of <br />Paonia in which the two government agencies agree to the permanent storage of the <br />excess rock at the Paonia sewage lagoons. As a requirement for revision approval, please <br />provide a copy of the Free Use permit mentioned in the USDA-Forest Service letter dated <br />December 4, 2007 when it has been issued. <br />Office of <br />Mined Land Reclamation <br />Denver • Grand Junction • Durango <br />Office of <br />Active and Inactive Mines
