III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) on 09 February 2010. The weather was cloudy and the <br /> ground was snow covered during the inspection of the site. Seth Puls of TMI and Rob Zubak of <br /> CORMS accompanied the inspection. <br /> Trapper continues to progress with mining in the F-Pit and the Q Seam in K-Ridge. Activity in Horse <br /> gulch is progressing as excess spoil was being placed at the time of the inspection. <br /> Roads <br /> The Life-of-Mine road was dry and stable at the time of the inspection. Roadside ditches were in <br /> compliance with no problems noted. Small amounts of fugitive dust were observed off of the LOM <br /> road traffic. Seth Puls of TMI requested a water truck be deployed on the road at the time of the <br /> inspection. Water was applied during the inspection. <br /> The middle Z haul road and the Horse Gulch Fill haul roads were stable with no problems noted. <br /> Hvdrolonic Balance <br /> Middle Flume Pond clean out has been conducted and was completed on 2/5/10. Final clean-up and <br /> grading has yet to be completed. Pond access roads have been graded to allow for maintenance of <br /> the pond. A small pool of water was holding in the pond at the time of the inspection. The final <br /> survey of the completed clean out has yet to be conducted. <br /> -.Z <br /> Middle Flume Pond Clean-out <br /> Support Facilities <br /> Construction was being conducted in the area of the new shop complex. Screw caissons have been <br /> completed. The East Panel ready line construction is progressing with the substation in place. <br />
