We are responsible for permitting and <br />inspecting coal mines. Reclamation plans must be approved by the DRMS before an operator reclaims the mine. <br />Specific reclamation success standards are part of the permitting process. For areas where wildlife habitat is the <br />part of the proposed post-mining land use, the reclamation success standards are based on herbaceous cover, <br />herbaceous production, species diversity and may include woody plant density (a minimum number of established <br />shrubs/acre). The woody plant density standard is to be developed in consultation with the Colorado Division of <br />Wildlife. One of our regulations, Rule 4.15.8(7) requires the DRMS to "consult with" and obtain the "approval by <br />CDOW' regarding "minimum (woody plant) stocking levels, planting arrangements, and methods for mitigation of <br />potential adverse impacts" to wildlife. <br />At the Bowie No. 2 Mine, the designated post mining land use is rangeland/ wildlife habitat. In the attached letter <br />dated May 2, 2008, Jim Stover, a Consulting Engineer for Bowie Resources LLC, sent you a copy of the Bowie <br />No. 2 Mine's revegetation section along with Map 18 that shows the proposed locations of shrub clumps. In order <br />for DRMS to approve BRLLC's proposed plan we must have DOW's concurrence on the proposed planting <br />arrangement. Additionally, Bowie is not proposing a woody plant density standard. This is acceptable to DRMS, <br />however, we must consult with CDOW before we can approve no woody plant density standard. <br />In summary we are requesting written documentation from the CDOW regarding: 1) the lack of a woody plant <br />density standard and 2) the proposed planting arrangement shown on Map 18 submitted by BRLLC. <br />Please feel free to contact me if you have any questions. <br />Thank you for your assistance, <br />Sandra L.
