Cattany <br />Paonia, Colorado 81428 Division Director <br /> Natural Resource Trustee <br />RE: Bowie No. 2 Mine, Permit No. C-96-083, Bowie Resources LLC <br />Technical Revision No. 52, Thirteen Gob Vent Boreholes, Second Adequacy Review <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Bowie Resources LLC's (BRL) responses dated March 3, 2008 for Technical Revision No. 52 (TR-52) for the <br />Bowie No. 2 Mine. The following is the status of the Division's questions and comments: <br />Section 2.03.6, Right of Entry and Operation Information <br />Please provide documentation that the USDA-Forest Service and the Bureau of Land Management <br />approve of this project. The Division understands that the NEPA process will be utilized for TR-52. <br />In the submittal dated March 3, 2008, BRL committed to providing the USDA-FS and BLM <br />approvals. <br />Section 2.05.4, Reclamation Plan <br />2. In the cover letter for the TR-52 submittal, BRL requested incremental bonding. The Division was <br />agreeable with incremental bondingprovided a certain methodology was used. In the submittal dated <br />March 3, 2008, BRL decided not to use incremental bonding. Therefore, the Division calculated the <br />total reclamation bond for TR-52. <br />Attached is the Division's reclamation cost estimate for TR-52. The estimate consists of a summary <br />sheet and tasks nos. 271 through 278, for a total of nine tasks, and represents an increase in liability of <br />$273,624.00. <br />The Division's estimate is approximately $75,000 more than the estimate submitted by BRL. The <br />main reason for the higher Division estimate is the earthwork costs (dozer tasks nos. 272-275). BRL <br />estimates the earthwork costs at approximately $14,000, while the Division estimates the earthwork <br />costs at approximately $93,000. In BRL's estimate, a generalized cost of $90/hour for the equipment <br />and a generalized time of4 hours/pad for reclamation is used. The Division estimates the quantity of <br />dirt moved and the variables (adjustment factors) that go into the tasks. Additionally, there does not <br />appear to be a cost for topsoil replacement in the BRL estimate, which accounts for approximately <br />$28,000 of the earthwork costs. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand junction • Durango Active and Inactive Mines
