Cattany <br />Division Director <br />Natural Resource Trustee <br />The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of <br />Bowie Resources LLC's (BRL) October 5, 2007 submittal for Technical Revision No. 49 (TR-49) for the <br />Bowie No. 2 Mine. The following is the status of the Division's questions and comments: <br />Rule 2.03.10, Identification of Other Licenses and Permits <br />As stated in the TR-49 cover letter, BRL has applied for a Colorado Department of <br />Transportation highway access permit. Please provide a copy of the highway permit when it is <br />obtained for inclusion into the permit application. Also, please update Section 2.03. 10 of the <br />permit application to identify this permit. <br />The Division has no further concerns. A copy of the CDOT permit was included in the October 5, <br />2007 submittal. The Division notes that the CDOT permit incorrectly states the purpose of the <br />permit. The coal waste is to be hauled from the north side of Highway 133B to the south side of <br />Highway 133B, not the other way around as is stated in the CDOT permit. <br />2. Which entity owns the road in this area that meets Bowie Road from the south and are any <br />permits necessary since the access onto Bowie Road will be changed? <br />In the October 5, 2007 submittal, BRL stated that the 4369 Lane is owned by BRL. However the <br />CDOT permit refers to the road as 4365 Lane. Please clarify. <br />3. As also stated in the TR-49 cover letter, BRL is working with the Bureau of Reclamation <br />concerning any permits for crossing the Fire Mountain Canal. Please provide documentation that <br />the Bureau of Reclamation approves of this project. I fa permit is obtained, please provide a copy <br />of the permit for inclusion into the permit application and update Section 2.03. 10 to identify this <br />permit. <br />BRL stated that the permit will be sent to the Division when it is received. <br />4. As also required under Rule 2.05.6(1), please provide any copies of construction permits, if any <br />are required, from the Colorado Department of Public Health and the Environment concerning <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
