J. J. Dudash -3- February 3, 2010 <br />8. On page 36 of Exhibit 15 of Volume 111, the first sentence states that ephemeral and <br />intermittent streams are within the permit area. Please add perennial streams to this <br />statement since portions of Hubbard Creek and Terror Creek are within the permit area. <br />BRL - Perennial streams were added to the first sentence on page 36. <br />9. DRMS - As required under the subsidence control plan of Rule 2.05.6(6)(f), please add an <br />appropriate discussion concerning the Curecanti-Rifle transmission line and the two <br />transmission line towers to the Subsidence Handbook in Exhibit 15 of Volume 111. Also, <br />please add a reference to the transmission line and towers in the next to the last paragraph <br />on permit application page 2.05-116. <br />BRL - The requested reference was made to page 2.05-116. A new page 46 was added to <br />the Subsidence Handbook to discuss the transmission line towers. <br />10. DRMS - Please update the appropriate maps to show the change in the mine plan. These <br />same maps should be updated with the current permit boundary, if necessary. <br />BRL - Maps 7, 8, 9, 25 and 27 are enclosed. Map 14B was submitted with the original TR <br />package. <br />11. DRMS - Please provide documentation that surface owners above and adjacent to the <br />underground mining areas proposed in TR-65 have received proper notification of the <br />mining schedule, as required under Rule 4.20.2. <br />BRL - By letter dated April 19, 2001, the USDA-FS and BLM were given notice under Rule <br />4.20.2. Maps 14 and 27 were referenced in the letters. Since the USDA-FS and BLM <br />receive all of the updates to the two maps they are continually updated on BRL's mining <br />plans. By letter dated January 29, 2010, notice was provided to the BLM about the 1 West <br />Mains that will extend under Terror Creek under BLM Managed surface. A copy of the letter <br />is attached. <br />Reclamation Cost Estimate <br />12. DRMS - Attached is the Division's reclamation cost estimate for TR-65 - drilling one <br />geotechnical hole and credit for gob vent holes not drilled. The estimate is comprised of five <br />tasks and represents a decrease in liability of $135,569.00. This decrease is slightly less <br />than the $135,979.00 shown in the estimate submitted by BRL. The main reason for this <br />difference is that BRL uses a standard percentage for indirect costs versus the actual <br />calculated indirect costs used by the Division. <br />The cost decrease comes from gob vent boreholes not drilled and the associated drill pad <br />and light use road reclamation not needed. The gob vent boreholes that were removed are <br />GVB-9B, GVB-1OB, GVB-IODG, GVB-11C, GVB-11D and GVB-11E from TR-52; drill pad <br />192 from MR-104; and GVB-106 and GVB-1OU2 from MR-106. <br />Please inform the Division in writing whether or not the Division's reclamation cost estimate <br />calculation is acceptable to BRL. <br />BRL - The DRMS' reclamation cost estimate is acceptable.
