Catt <br />Division Director <br />or <br />Natural Resource Trustee <br />RE: Bowie No. 2 Mine, Permit No. C-1996-083, Bowie Resources LLC <br />2009 Midterm Permit Review, Adequacy Review <br />Dear Mr. Bear: <br />The Division has reviewed Bowie Resources LLC's (BRL) responses to the 2009 Midterm adequacy <br />review for the Bowie No. 2 Mine. The following is the status of the issues: <br />The Division asked if the 3000 cubic yards of soil material that had been taken from the Hubbard <br />Creek vent shaft project and temporarily stored at the Bowie No. I Mine was still available for <br />reclamation at the Bowie No. 2 Hubbard Creek vent shaft site or had it been used in the Bowie <br />No. I Mine reclamation. <br />The Division has no further concerns. BRL responded in a letter dated October 26, 2009 that, of <br />the 3000 cubic yards of rock and soil that were taken from the site, 1140 cubic yards would be <br />returned to the Hubbard Creek vent shaft site for reclamation. There is an assumption being made <br />that this volume of material will be enough to achieve approximate original contour. However, the <br />success in achieving approximate original contour can only be made at the time of bond release. <br />The Division was concerned that the Freeman Gulch area landslide of June 2007 may have been <br />caused by outcrop barrier pillar failure due to mine induced subsidence. The Division requested <br />that BRL reexamine the issue of outcrop barrier pillars and whether more protection is needed. <br />The Division has no further concerns. BRL responded in a letter dated October 26, 2009 that the <br />initial roof fall on the east side of panel B-6 affected an area that was already predisposed to failure <br />due to historic subsidence from burnt B-seam and D-seam coal. It appears that no reasonable <br />amount of increased barrier pillar width would have prevented the landslide in this area. <br />3. The Division has re-evaluated the original 2009 Midterm reclamation cost estimate based on two <br />questions e-mailed to the Division on December 2, 2009 by Jim Stover, consultant for Bowie <br />Resources LLC. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
