Western Fuels-Colorado
P.O. Box 628 RECEIVED.
Nucla, Colorado 81424
January 20, 2010 ,IAN 2 7 2010
pivisinn otk a S?etY n,
mining and
RE: Reclamation of Morgan Property
Dear Lance Wade:
Thank you for the offer, but NO thanks. The Permit-Revision #6 is willingly and knowingly
providing false information to the DRMS, as well as to the public and all the landowners. Lance,
most of the entire revision not only cuts the farmers to shreds, but also the information that it
contains is just right out LIES. We have lived here all of our lives. We know how each and
every person did their property and what it looked like before the mine entered the property.
We are going to count on the law to do its job and the regulatory agency is suppose to make you
do your job. We have read the proposal thoroughly and it specifically states that WFC will
furnish soil preparation, discing, leveling, etc. Lance we have a contract signed by you to already
be the ones who do all of that work. No one else is going to do that work! That is why we had
the contract put in the lease. We are going to do the Morgan Place! We don't want WFC to
furnish whatever documentation the DRMS requires because the documentation that you have is
all false and all lies. We have always irrigated the entire property and when you get an aerial
photo in 1998 in the FALL, we might have been doing anything with a piece of property and if it
has ANY GREEN, IT WAS IRRIGATED. I will have NRCS write you a letter to that effect!
The field that you have as UNDEVELOPED is one of our biggest producers now, since the
Sunshine Corner is no longer. That is why we plow fields up and re-do fields is so that we can
make them the most productive. Also, prairie dogs have been a problem for over 100 years on
your place, on the mine, every where, so quit taking another wack at us because they will always
beat a problem and we just keep shooting and killing and hoping for the plague to kill them off,
but we do work at it EVERY YEAR! They are EVERYONES' problem!
The Property at the Sunshine Corner is in far worse shape now than it was. The way it is already
being put back is horrible. There is No way that we could ever use gated pipe or furrow irrigate
ever again. You can stand at the fuel docks and see for yourself that the property is not put back
any where as good as it was and the only alternative now is a side roll , center pivot, etc. And by
the way Lance, we have not flood irrigated on this place for 39 YEARS. AND we have never
"WILD flood irrigated. WHY would we want to set irrigation back in time to please you? We
will never flood irrigate again, that's why we bought side rolls and center pivots. NO ONE IN
THIS AREA HAS EVER WILD FLOOD IRRIGATED! Another made up lie by Ross. We do
not want any tail ditches either. It needs to be put back as good as or better as the law states.
And for your information, since 1996, the Sunshine Corner and the other corn field, totalling
over 100 acres has had a max of 45 shares. Check the ditch company for yourself. NOT Ross,
you check for yourself. AND the most we have ever had since 1985 is 60 shares to do 120 acres.
