(b) Classified areas: Operations that may affect the quality of ground water in a specified <br />area that has been classified by the WQCC shall comply with standards applicable <br />to such specified area. <br />(c) Unclassified areas: operations that may affect the quality of groundwater, which has <br />not been classifiedby the WQCC, shall protect the existing and reasonably potential <br />future uses of such groundwater. <br />(d) Water quality standards applicable to groundwater that has been classified, state- <br />wide standards for certain pollutants, and interim narrative standards set by the <br />WQCC shall supersede any numeric protection levels established for the subject <br />pollutants to this Subsection 3.1.7 <br />3.1.8 Wildlife <br />(1) The operator will consider the safety and protection of wildlife on site. No described critical <br />periods or species are known by this operator/applicant or landowner. The COLORADO <br />DIVISION OF WILDLIFE statement/evaluation prepared by Jeremy Gallegos, DWM, CDOW <br />dated July 12, 2006 is attached to this report in Exhibit "H". Mr. Gallegos stated, " Although impact <br />to shortgrass habitat will be likely, the overall impact to wildlife species is minimal." <br />(2) No habitat management is planned on this site. Reclamationis planned rangelandnot wildlife <br />habitat. <br />3.1.9 - Topsoiling <br />(1) Topsoil will be stockpiledin close proximity to the mine areas in order to shorten haul distances <br />to and from the areas that were stripped. Once the topsoil has been removed and segregated from <br />the other spoil or product, it will be saved for replacement. If the duration before use exceeds one <br />full growing cycle, the topsoil stockpiles will be seeded with a westernwheatgrass to control erosion. <br />(2) Mining on the affected lands will disturb little to no woody vegetation. However, if any volumes <br />of woody vegetation are produced, they will be properly placed in areas segregated from the topsoil <br />stockpiles and used in conjunction with the reclamation. <br />(3) Stockpiles will be configured to minimize erosion and will be located in areas where disturbance <br />by ongoing mining operations will be minimized. As stated in 3.1.9 topsoiling (1) above, if <br />necessary, stockpiles will be seeded for the purpose of stabilization. <br />(4) It is planned to locate topsoil stockpiles so material will only have to be handled one time. No <br />relocation of topsoil is proposed. <br />(5) The operator will take measures to assure the stability of replaced topsoil on graded slopes by <br />roughing the subgrade to gain a mechanical bond to the topsoil being replaced. This should insure <br />the elimination of any slippage zones.
