Cattany
Parker, Colorado 80138 Mining and Safety Division Director
Natural Resource Trustee
Re: Gehrman Gravel Pit, M-2009-078, 112c Permit Application Alo:-M4009
Reclamation Liability Estimate.
Dear Mr. Langenfeld,
The Division of Reclamation Mining and Safety (DRMS) has received Lewicki and Associates responses to staff
review of the above referenced application. It appears that all issues have been addressed to meet the
requirements of the Act and Rules. The Division has received a "Letter of Withdrawal" from Mr. Jay Wagner the
lone objector to the application. Therefore DRMS may finish the review process and issue a decision on the
original due date of January 12, 2010 provided the final issue of the reclamation liability estimate is resolved.
Please find enclosed the Final Reclamation Liability Estimate prepared by DRMS staff. Overall the tasks costs are
similar to those in Exhibit L with the exception of pumping down the pit. Without details of how the tasks were
estimated it is difficult to determine where any discrepancy lies. That said staff has calculated the reclamation
liability to be $88,975.00. Please review the estimate and contact staff immediately if there are any
discrepancies or errors that might affect the overall costs. If Elam and Lewicki accept the estimate, staff will
need acceptance correspondence by phone or e-mail with a hard copy in the mail as soon as possible. If Elam
wishes additional time to review the estimate beyond tomorrow an extension request will be necessary to finish
up the process.
If you need additional information, please contact me at the Division of Reclamation, Mining and Safety, Grand
Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, telephone no. 970.241.1117.
Sincerely,
G.
