///. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of DRMS. Rozellyn Hall and Kathy <br />Welt represented the operator. <br />Photographs taken during the inspection are attached to the end of this report. With the operator's <br />consent, this report was issued from the Denver office of DRMS. <br />The longwall was active more than half of the way through E-Seam Panel 1. The ground was covered <br />with more than 1 foot of snow, which limited observations. Snow cover also prevented access to <br />higher elevations; the inspection was limited to the main surface facilities area, Sylvester Gulch, and <br />the train loadout. <br />Availability of Records <br />Required records were on file in the mine office (see attached list). <br />Signs and Markers <br />Mine i.d. signs were properly displayed at the two entrances to the main surface facilities area on <br />Highway 133 and at the entrance to the train loadout on Highway 133. Topsoil markers were properly <br />displayed in all areas inspected. Although the perimeter of surface disturbances is well marked, the <br />possible need for additional markers, especially in outlying areas, was discussed. Stream buffer <br />markers were in place in Sylvester Gulch and next to the North Fork of the Gunnison River along the <br />northern perimeter of the main facilities area. <br />Roads <br />Road surfaces were in good condition in all areas inspected. <br />Hydrologic Balance <br />The following sediment control ponds appeared to contain low levels of water underneath snow cover <br />and were not discharging: MB-1, MB-2R (CDPS outfall 004), MB-3 (CDPS outfall 005), SG-1 <br />(CDPS outfall 014), and MB-4 (CDPS outfall 008). The embankments and inslopes of these five <br />ponds appeared in good condition, although snow cover limited observations. <br />No discharge was occurring at the mine water discharge site in Sylvester Gulch (CDPS outfall 017). <br />Pond MB-5E was under construction next to the North Fork of the Gunnison River. This project was <br />recently approved in TR-119. Silt fence was in place along the length of the construction area next to <br />the river. <br />3
