ALTERNATE LIMITATIONS FOR POST-MINING RECLAMATION AREAS Any discharge or increase in the volume of a discharge from a reclamation area, caused by precipitation within any 24-hour period greater than the 10-year, 24-hour precipitation event (or snowmelt of equivalent volume) mgy substitute the following limitations for these specific parameters only, subject to burden of proof requirements described in Part I.B.6 of the permit. The Sediment Control Plan requirements in Part I.B.3.b. of the permit apply to the reclamation areas at this facility. The permittee shall prepare and submit a Sediment Control plan by July 1, 2009. The Division will review the Sediment Control Plan and approve it. Once approved by the Division, the Sediment Control Plan will become a part of this permit certification by reference. Compliance Schedule for Sediment Control Plan for Reclamation Areas Code 12505 A Sediment Control Plan shall be prepared and submitted by July 1, 2009 for the Reclamation Areas as required under Part I.13.3.b. of the CDPS General Permit for Coal Mining Facilities and 40 CFR 434.82. The plan required by this compliance schedule shall be directed to the Industrial Unit of the Permits Section for final review. Total Maximum Daily Loads / 303(d) Listings Segment 04 and the main stem of the Purgatoire River are on the 303(d) list as impaired for selenium with a designation of a Low priority. A TMDL has not yet been developed or finalized, and therefore waste load allocations have not been made for this parameter. At such time as a TMDL is complete, this certification may be reopened, and limitations and or monitoring requirements may be added. Until such time, monitoring and reporting of this parameter will be required.
