Exhibit D - Reclamation Plan <br />9. We include a revised reclamation plan map showing the both the approximate location of the <br />existing mined area and the area to be mined in phases 1, 2, and 3. <br />10. The Operator hereby amends the wording in the Reclamation plan from 'I 11 permit' to ` 110 <br />permit' <br />I I.There is no overburden to be removed since the basalt rock outcrops within a few inches of <br />the surface or at the surface. <br />12. Reclamation will commence in 2011, and end in 2014 and 4 phases as shown on the <br />accompanying revised reclamation map. <br />13. The steep slopes are due to the fact that since this Pit is located on a prominent escarpment <br />that extends several miles in both directions, except for where livestock access is intended little <br />or no benefit is derived from making 3H: 1 V slopes. <br />14. Response is same as given in Exhibit C, item3, namely that the Operator commits to <br />stockpiling topsoil or importing fines from the nearby Robins Gravel Pit sufficient to cover <br />reclaimed area with 6 to 12 inches of topsoil. <br />15. Re-seeding will begin with the start of reclamation operations in 2011 and reseeded areas <br />will be set off with perimeter fencing. Seedbed will be prepared with a harrow. <br />16. Seeding will be completed using the seeding program established by the USDA Conejos <br />County Office of the Natural Resources Conservation Service enclosed herewith. The Operator <br />will use Indian Ricegrass, Sand dropseed, Bottlebrush Squirreltail, Blue gramma, and Four-wing <br />Saltbush as shown on the NRCS seed plan. No fertilizer will be applied. <br />17. Seed will be mechanically broadcast at twice the rate shown on the accompanying NRCS <br />seed recommendations. <br />18. Barley straw will be hand broadcast at 2000 lbs per acre and will be mechanically crimped <br />with a light weight rubber tired vehicle (ATV). <br />19. Please disregard this statement. The reclamation plan to be implemented is for the 110 <br />permit, and includes that area previously shown in the 111 premit application. The Operator <br />understands that Operator is still obligated under the 111 permit to reclaim that land as well. <br />Exhibit E- Map <br />20. We have outlined and labeled the existing disturbance within the permit boundary and <br />acknowledge that Operator's responsibility to reclaim the existing disturbance shall remain in <br />effect under the 110 Reclamation Permit.
