6.3.5 Exhibit E - Map <br />5. Please outline and label the existing disturbance within the permit boundary on the Mining <br />Plan Map as required by Rule 6.3.5(2)(f). <br />6.3.12 Exhibit L - Permanent Man-Made Structures <br />6. The Applicant has stated the "The surface and subsurface owner, Aniceto Lucero has entered <br />into a lease agreement with Robins Construction Co., LLLP which has been notarized and <br />specifically calls for damages to be made good by the lessee". A review of the submitted <br />lease did not find any mention of compensation for damage to structures. Please provide the <br />Division with a notarized agreement between the Applicant and the Person(s) having an <br />interest in the structure, that the Applicant is to provide compensation for any damage to the <br />structure. <br />As previously mentioned, if you are unable to provide satisfactory responses to any inadequacies <br />prior to January 18, 2010, it will be your responsibility to request an extension of time to <br />allow for continued review of this application.
