I1I. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> No problems were noted during the inspection with respect to drainage or sediment control <br /> issues, or other water quality related problems in the original permit area lands which would be <br /> subject to the Division's proposed SL-2 release. All disturbed land within the areas subject to <br /> SL-2 proposed release does drain to an approved sediment pond or Small Area Exemption <br /> treatment structure, with the exception of certain permanent road segments that are exempt from <br /> the sediment pond requirement. <br /> Phase 1 Bond Release Reclamation Success Summary <br /> Based on site inspection, the reclaimed areas included within the original permit area portion of <br /> the SL-2 bond release request(delineated on SL-2 Map Figures 1&2) appear to have been <br /> restored to the approximate original contour of the pre-mining landscape. Slopes are in general <br /> conformance with approved post-mining contours as shown on the Postmining Topography Map <br /> of the approved permit (Exhibit 20-2) and, with exception of the"A" Pit highwall slump area <br /> noted in this report, appear to be stable. Reconstructed drainages within the original permit area <br /> are for the most part in good condition, with only a few exceptions noted where significant <br /> further work is required(e.g. sections of Channel 006-NE2 and 006 Gulch). Minor hillslope <br /> erosion and minor channel erosion was noted in a number of locations,but the extent and nature <br /> of the erosion observed in most locations was within the context of"maintenance items" to be <br /> addressed in the context of the Rill and Gully Plan of the approved permit. Some progress had <br /> been made with respect to such maintenance subsequent to the SL-2 inspection,but due to snow <br /> cover in November and December, the Division was unable to make detailed follow-up <br /> observations. Erosional maintenance items identified in this report will need to be properly <br /> implemented prior to the end of the 2010 field season. <br /> For the reasons discussed at the beginning of this report, the Division will exclude the entire <br /> South Extension portion of the permit area from the SL-2 proposed approval decision. In <br /> addition, the Division will exclude an unstable reclaimed highwall slope area, segments of two <br /> permanent channels where significant repair work is necessary, and segments of a number of <br /> proposed permanent roads for which required documentation had not been provided. Map <br /> Figures 1 and 2 attached to this report delineate the areas requested for release in SL-2, those <br /> areas the Division will propose to approve for release and those areas the Division will propose <br /> to exclude from the SL-2 approval. Photographs supporting the observations and determinations <br /> noted in the report narrative and included in Attachment 1. <br /> 20 <br />
