� Y <br /> III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> Permanent roads are addressed in a previous section of this report. <br /> Proper documentation to support retention of fencing and electrical facilities has been provided <br /> within Attachment 20-2 of the approved permit. The Division will propose to approve the <br /> fencing and electrical facilities within the original permit area, which were included in the SL-2 <br /> request, for Phase I bond release within the SL-2 proposed decision. See Phase 1 Bond Release <br /> Exhibit B, of the SL-2 application for delineation of the fencing and electrical facilities proposed <br /> for retention. <br /> Hydrologic Balance <br /> The preponderance of the mine pit reclaimed acreage in the northern portion of the original <br /> permit area("D" and "C" Pit areas) drains to the west via the 005 drainage system and is treated <br /> by Sediment Pond 005 (Photo SL2-4). Pond 005 water level was approximately 4 feet below the <br /> top of the permanent spillway riser at the time of the inspection, and was not discharging. Small <br /> areas along the eastern ridgeline in the northern portion of the original permit area drain to the <br /> east, and are treated by Sedimentation Pond 009. Pond 009 was not inspected during the SL-2 <br /> inspection,but was inspected on 9/24/09, and was functioning properly. The pond has <br /> historically been stable and functional, and has consistently met CDPS permit discharge limits <br /> for settleable solids. Former Topsoil Stockpile PP,located along Road"G" drains into a Small <br /> Area Exemption excavated sump. The stockpile site and sump were both well vegetated and <br /> stable, with no indication of recent runoff or sedimentation into the sump. <br /> The preponderance of mine pit reclaimed acreage in the central and southern portions of the <br /> original permit area("A" and `B"pits areas) drains to the west via the 006 drainage system, and <br /> is treated by Sediment Pond 006. Pond 006 embankment was stable and the pond was <br /> discharging clear flow at the time of inspection. The pond discharge has consistently met CDPS <br /> permit discharge limits for settleable solids. A small acreage along the eastern side of the eastern <br /> ridgeline in the central portion of the original permit area drains into Sedimentation Pond 009, <br /> while a small area along the east side of the ridgeline at the southern end of the original permit <br /> area drains into Sedimentation Pond 015. Pond 015 was not inspected during the SL-2 <br /> inspection,but was inspected on 9/24/09, and was functioning properly. The pond has <br /> historically been stable and functional, and has consistently met CDPS permit discharge limits <br /> for settleable solids. <br /> 19 <br />
