. t <br /> III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> Observations made during the SL-2 inspection with respect to specific reclaimed watersheds in <br /> the original permit area are addressed below; reference is also made as appropriate to <br /> measurements taken and observations made during detailed drainage reestablishment inspections <br /> in 2005/2006. In general, drainage conditions and watershed stability have improved <br /> considerably since the 2005/2006 inspections, due both to maintenance work conducted by the <br /> operator in the intervening years and to increased ground cover in the reclaimed watersheds. <br /> However, locations remain where maintenance is warranted to repair instances of both hillslope <br /> and channel erosion. In a couple instances the Division considers the extent of maintenance to be <br /> sufficient to warrant exclusion of defined drainage segments from the SL-2 approval area. In <br /> most cases,required maintenance is of relatively minor magnitude and will not preclude approval <br /> in SL-2,but will need to be completed prior to the end of the 2010 field season. In addition to <br /> instances of hillslope and channel erosion, one significant area of mass instability was noted on a <br /> reclaimed highwall slope in the upper 006 Gulch watershed, and the area affected by the <br /> instability will be excluded from the Division's proposed SL-2 approval area. The reclaimed <br /> watershed observations are presented below, presented in the order the drainages occur on the <br /> landscape from north to south across the permit area. <br /> Channel 005-El <br /> The drainage channel runs from east to west along the toe of the reclaimed"D"Pit highwall, at <br /> the extreme northern end of the permit area. The channel extends from near the ridgeline along <br /> the eastern perimeter of the mining disturbance area down to the 005 Gulch confluence,just <br /> upstream of Stock Pond T-20. The channel itself is riprapped and stable along its entire length, <br /> Photo SL2-10 is representative. There has been some recent ground settling along short <br /> segments near the west end of the regraded highwall slope,where cracks and minor scarps with <br /> up to a foot of displacement were graded over by the operator prior to the SL-2 inspection(see <br /> Photos SL2-7 and SL2-11). Continued visual monitoring will be warranted in the settlement <br /> repair areas. A few hillslope rills were also recently repaired on slopes adjacent to the channel <br /> (repair areas visible in Photo SL2-7, across the channel from the settlement repair location. <br /> 005 Gulch <br /> This permanent channel runs generally southeast to northwest through the former"C" and"D" <br /> Pit areas in the northern portion of the original permit area. The reclaimed drainage extends from <br /> the eastern ridgeline down to its junction with 005-E1, a short distance upstream from Stock <br /> Pond T-20, and continues for a short distance downstream to T-20, and from the outlet of T-20 <br /> for a short distance to the pit area disturbance boundary. Stock Pond T-18 is also located on the <br /> 10 <br />
