b. The applicant is required to notify any easement holders adjacent to and including <br />County Road 61 due to the construction of the Pickering Family Pit access road. Please <br />provide proof of notice to Grand County Road & Bridge and any utilities adjacent to CR <br />61. <br />c. Please provide proof of notice to the owner of the surface and mineral rights of the <br />affected land, Pickering Family, LLC. <br />The Division received comments from the Colorado Historical Society. The letter is attached for <br />your review. Please address the comments noted in the letter and make any changes in the <br />application as necessary. <br />Exhibit C Pre-mining and Mining Plan Map of Affected Lands (Rule 6.4.3) <br />The applicant states an unnamed seasonal tributary to Smith Creek will receive any of the stormwater <br />discharge from the treatment pond that will be constructed per the Stormwater Management Plan. <br />4. Please commit to providing the Division with a copy of the approved Stormwater Management <br />Plan from the Colorado Department of Public Health and Environment. <br />5. Please depict the location of the stormwater discharge point on the Mine Plan Map. Please <br />provide consent to discharge water into the seasonal tributary to Smith Creek. If water is <br />discharged into an unlined tributary, it may be prone to erosion if the discharge rates exceed <br />the carrying capacity of the tributary. The applicant should submit documentation to the <br />Division for review as to the proposed maximum discharge rate into the tributary and <br />specifications as to how much water the tributary can carry without experiencing erosion. <br />6. Please depict the location of the treatment pond on the Mining Plan Map. <br />Exhibit D Mining Plan (Rule 6.4.4) <br />7. Please confirm the applicant intends to operate the site continuously or if the Division should <br />consider the site an "intermittent operation" as defined in C.R.S 34-32.5-103(11)(b). <br />8. The applicant states they would like the option to include a portable asphalt batch plant/and or <br />portable concrete plant. The applicant must provide a revised Mine Plan Map indicating the <br />proposed location of asphalt batch plant and/or concrete plant. Please provide the Division <br />with proof of the Grand County special use permit allowing the asphalt/concrete plant, the <br />required Air Pollutant Emission Notice (APEN) and Hazardous Material and Spill Control permits <br />from the Colorado Department of Public Health and Environment prior to operating the <br />asphalt/concrete plant at the site or commit to submitting a technical revision to the permit per <br />Rule 1.9 prior to operating an asphalt/concrete plant.
